Terms of Usage

1. AGREEMENT

These Terms of Usage ("Terms") are a legally binding agreement between you ("you", "citizen") and CreJik Technologies Private Limited ("CreJik", "we", "us"), having its registered office at A6-A9, New Haven, Palghar, Maharashtra - 401501, India, governing your access to and use of the TruCitizen application, website and related services (the "Services"). By creating an account or using the Services you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. PURPOSE OF THE PLATFORM

TruCitizen is a social platform built to promote India and its core values. Citizens prove their knowledge of India and improve their competence through timed challenges, earn badges and rankings, and connect with fellow citizens. We encourage social collaboration and bring citizens closer to one another to promote the spirit of nationalism and to accept and endorse India's diverse cultures, beliefs, traditions and languages, so that every citizen feels prouder of their motherland. Content on the Platform is provided for civic engagement and general knowledge and does not constitute professional, legal, financial or academic advice or certification.

3. ELIGIBILITY AND ACCOUNT

You must be at least 18 years of age and legally capable of entering into a contract under Indian law. You may hold only one account, created by signing in with Google (on Android and iOS) or with Apple (on iOS). You are responsible for all activity under your account and for keeping your device secure. Usernames must be 6 to 9 alphanumeric characters, must not impersonate any person, institution, public office or brand, and must not be misleading, obscene or unlawful. We may reclaim or change a username that violates these Terms.

4. CHALLENGES, SCORING AND RANKINGS

Each challenge presents questions under a server-enforced time limit; an attempt cannot be edited after submission or after the time limit ends. Scores, percentiles, rankings, badges and leaderboards are computed by CreJik's proprietary engine. The selection, wording, difficulty, correctness determination, number, ordering, availability and withdrawal of questions and challenges, the scoring and ranking methodology, the award or revocation of badges, and the design and duration of competitions are at the sole and absolute discretion of CreJik and may be changed at any time without notice. CreJik's determination of a score or rank is final. Rankings reflect performance among participating citizens on the Platform and are not a certification or an assessment of any person for any external purpose.

5. FAIR PLAY

You agree not to use automated tools, scripts, bots, multiple accounts, shared accounts, screen- scraping, tampering with timers or network traffic, collusion, or any other means to gain an unfair advantage or to manipulate scores, rankings, referrals or competitions. We may invalidate attempts, remove badges, adjust rankings, withhold rewards and suspend or terminate accounts involved in or benefiting from unfair play, at our sole discretion and without liability.

6. NO SCREENSHOTS, RECORDING OR MIRRORING

The app contains technical measures that disable screenshots, screen recording, screen mirroring and screen casting throughout the app. These measures exist to protect the privacy of citizens and the confidentiality of challenge content. You agree that you will not attempt to bypass, disable or circumvent these measures by any means, including the use of rooted or jailbroken devices, emulators, modified applications, external cameras or third-party tools. You further agree that you will not capture, record, reproduce, publish or share any part of the app's screens, any challenge content, or the profile or activity of any other citizen, whether or not the technical measures functioned on your device. The sharing features expressly provided within the app, such as sharing your own badge or referral card, are the only permitted means of sharing content from the app. Any breach of this clause is a material breach of these Terms. CreJik may, at its sole discretion, invalidate attempts, remove badges or rankings, suspend or terminate your account, and pursue any remedy available under applicable law, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.

7. PAID PLANS AND PAYMENTS

The Indian Citizenship Challenge is complimentary once per account. Additional challenges require a paid plan. A plan is a one-time purchase of a fixed number of challenge credits; it is not a subscription, it does not renew automatically and no recurring charge is made. Credits are consumed as challenges are started. Current plans are Basic (3 additional challenges) and Pro (7 additional challenges). The price of each plan, the applicable taxes and the available payment options are shown in the app before you pay. Prices are displayed in Indian Rupees inclusive of applicable taxes and may differ between platforms and app stores because of platform fees; the price shown in the app on your device is the price that applies to you.

Payments are collected inside the app through secure payment partners or the purchase system of the app store from which you downloaded the app. CreJik never receives or stores your card, UPI, bank or app-store account payment details. A tax invoice or purchase receipt is issued to you by CreJik or by the app store, depending on how the purchase was made, and the app tells you which applies.

Plan structure, the number of challenges included, pricing, promotional offers and payment methods are at the sole discretion of CreJik and may be revised prospectively at any time; changes do not affect credits already purchased. Every purchase is verified on CreJik's servers before challenge credits are added to your account. Purchased challenge credits are personal, non-transferable and have no cash value, and may be used from the same TruCitizen account on either platform.

Refunds: Because challenges are digital services made available immediately, fees are non-refundable once a purchased challenge has been started, except where a refund is required by applicable law or where a verified technical failure attributable to the Platform prevented delivery of a purchased challenge, in which case we will re-credit the challenge or refund the amount at our discretion. Refund requests must be sent to the support address below within 7 days of the transaction. Where a purchase was made through an app store's own purchase system, the refund is requested from and decided by that app store under its terms, and CreJik may adjust or remove the challenge credits that were added for a purchase refunded by the app store. The app shows you the correct refund route for your purchase.

8. COMPETITIONS AND REWARDS

From time to time CreJik may run competitions with rewards. Eligibility, entry conditions, duration, reward structure, tax treatment and the method of determining winners are published with each competition and form part of these Terms. Competitions are governed by applicable Indian law and are void where prohibited. Rewards are non-transferable and CreJik may substitute a reward of equivalent value. Any tax on rewards is the responsibility of the recipient.

9. YOUR CONTENT AND CONDUCT

You retain ownership of the content you post (profile information, photo, bio, links, stories and shares) and grant CreJik a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, display, translate and distribute that content as needed to operate and promote the Services. You represent that you have all rights to the content you post. You must not post or share content that is unlawful, defamatory, obscene, hateful, harassing, threatening, discriminatory on grounds of religion, caste, community, language, gender or region, that incites violence or disharmony, infringes intellectual property, contains malware, or violates any applicable law including the Information Technology Act, 2000 and rules thereunder. TruCitizen exists to bring citizens together; conduct that demeans any community, culture, belief, tradition or language is a fundamental breach of these Terms.

10. PLATFORM ROLE AND MODERATION

CreJik operates the Services as an intermediary platform. We do not endorse user content and are not responsible for content posted by citizens. We may, but are not obliged to, review, translate, restrict, remove or decline to display any content and may suspend or terminate accounts that violate these Terms or applicable law, with or without notice. You may report content or accounts to the support address below; we act on valid reports in accordance with applicable law.

11. INTELLECTUAL PROPERTY

The TruCitizen name, logo, badge artwork, challenge content, questions, explanations, translations, ranking engine, software and all related materials are the property of CreJik or its licensors and are protected by Indian and international intellectual property laws. You receive a limited, personal, non-transferable, revocable licence to use the app for its intended purpose. You may not copy, reproduce, redistribute, scrape, decompile, reverse-engineer or create derivative works from any part of the Services, except for sharing features we expressly provide.

12. PRIVACY AND DATA PROTECTION

Our collection and use of personal data is described in the TruCitizen Privacy Policy, which forms part of these Terms. CreJik processes personal data in accordance with the Digital Personal Data Protection Act, 2023 and applies encryption, access controls and other reasonable security safeguards as described in the Privacy Policy.

13. AVAILABILITY AND CHANGES TO THE SERVICES

We aim to keep the Services available at all times but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any feature, challenge, language or the Services as a whole, and may impose limits on usage, at our discretion. Where a discontinuation affects challenge credits you have purchased but not yet used, we will re-credit or refund those credits. Availability of the app on Google Play and the Apple App Store, the store terms and the processing of payments made through a store are also subject to Google Play's and Apple's terms; where those terms conflict with these Terms regarding a purchase made through a store, the store's terms govern that purchase.

14. DISCLAIMERS

The Services and all content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose or non-infringement, to the fullest extent permitted by law. While we take care to keep challenge content accurate, CreJik does not warrant that any question, explanation, translation, score or ranking is free from error, and such content must not be relied upon for any examination, employment, legal, financial or governmental purpose.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, CreJik, its directors, officers, employees and agents shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or opportunity, arising out of or in connection with the Services, even if advised of the possibility. CreJik's total aggregate liability to you for all claims arising out of or relating to the Services shall not exceed the amount you paid to CreJik for the Services in the 12 months preceding the event giving rise to the claim, or ₹1,000, whichever is greater. Nothing in these Terms limits liability that cannot be limited under applicable Indian law.

16. INDEMNITY

You agree to indemnify and hold harmless CreJik and its directors, officers, employees and agents from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of your content, your use of the Services, your violation of these Terms or of any law, or your infringement of the rights of any third party.

17. TERMINATION

You may stop using the Services and delete your account at any time from Profile → Delete account. We may suspend or terminate your access immediately if you breach these Terms, engage in unfair play, create risk or legal exposure for CreJik or other citizens, or where required by law. Sections 4, 6, 9, 11, 14, 15, 16, 18 and 19 survive termination.

18. GOVERNING LAW AND JURISDICTION

These Terms and any dispute or claim arising out of or in connection with them or the Services shall be governed by the laws of India. Subject to applicable law, the courts at Palghar, Maharashtra shall have exclusive jurisdiction over all such disputes. Before initiating proceedings, you agree to first raise the matter with our support team and allow 30 days for an amicable resolution.

19. GENERAL

These Terms, together with the Privacy Policy and any competition-specific terms, constitute the entire agreement between you and CreJik regarding the Services. If any provision is held invalid, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. We may update these Terms from time to time; material changes will be notified in the app or by email, and continued use after the effective date constitutes acceptance. These Terms are between you and CreJik only; Google and Apple are not parties to these Terms and have no obligation to provide any maintenance or support for the Services. If you use the iOS app, you acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and that, upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary with respect to the iOS app, as required by Apple's Licensed Application End User License Agreement.
